An art student was beaten up and had to stay in jail for 5 days in Baroda for painting - here's the complete report....
The orignal post by Amit Varma is here....

Fascism in Baroda

I suppose many of you would be familiar with the recent events in Baroda. An internal evaluation of students is on at the Fine Arts Faculty in Baroda. A BJP leader named Neeraj Jain storms in with a bunch of gundas. He has a problem with some paintings by a student named Chandramohan that use religion imagery. Jain and his gundas beat up Chandramohan, and abuse faculty members and students. Things are getting out of hand when the police arrive. They will surely arrest Jain and put an end to this, you would think.
But no, they arrest the painter, for his art is the crime under the Indian Penal Code, not the hooliganism showed by Jain and his cohorts. Chandramohan is whisked off to jail. Five days later, as I type these words, he is still behind bars.
The artist community obviously rises up, and organises an exhibition documenting erotica in Indian and Western art. It is a peaceful way of showing their protest. The pro-vice-chancellor of the university arrives and demands that the exhibition be terminated. The dean of the faculty, Dr Shivaji Panikkar, takes a stand and refuses to do so. He is suspended. As I type these words, he is in hiding, worried about what the ruffians could do to him.
The matter is being followed at Art Concerns, who have a detailed chronology of events up here. Do also read what Ranjit Hoskote, Gulammohammed Sheikh and Johny ML have to say, as well as this piece by Abhijeet Tamhane. Peter Griffin has more links here, as well as details of a public protest I intend to be part of in Mumbai.
My feelings on this will be known to regular readers of India Uncut, and have been laid out in pieces like ”Don’t Insult Pasta” and ”Fighting Against Censorship”, as well as many posts (such as 1, 2, 3, 4, 5.) It is ludicrous that giving offence is a crime in India, and shameful that the Indian Penal Code actually enables this suppression of free speech, and empowers oppression. For Chandramohan the artist to be in jail for five days (so far) and for Neeraj Jain the gunda to walk free is a slap on the face of all those who think that our nation respects and protects individual freedom.
No doubt some readers will be upset that I used the word “Fascism” in the headline to this post. Well, I hesitated before doing so, wondering if such a strong word was advisable. Then I went to the Wikipedia entry on Fascism, and came across this excellent definition by Robert Paxton (from this book):
Fascism may be defined as a form of political behavior marked by obsessive preoccupation with community decline, humiliation, or victim-hood and by compensatory cults of unity, energy, and purity, in which a mass-based party of committed nationalist militants, working in uneasy but effective collaboration with traditional elites, abandons democratic liberties and pursues with redemptive violence and without ethical or legal restraints goals of internal cleansing and external expansion.

The Wikipedia article then quotes Paxton as summing up the essence of Fascism thus:
1. a sense of overwhelming crisis beyond reach of traditional solutions; 2. belief one’s group is the victim, justifying any action without legal or moral limits; 3. need for authority by a natural leader above the law, relying on the superiority of his instincts; 4. right of the chosen people to dominate others without legal or moral restraint; 5. fear of foreign `contamination.

All this sounds immensely familiar to me. And so I shall end by quoting the end of Ranjit Hoskote’s fine piece:
It appears that the champions of a resurgent Hindu identity are acutely embarrassed by the presence of the erotic at the centre of Hindu sacred art. As they may well be, for the roots of Hindutva do not lie in Hinduism. Rather, they lie in a crude mixture of German romanticism, Victorian puritanism and Nazi methodology.
What happens next? Will the champions of Hindutva go around the country destroying temple murals, breaking down monuments, and burning manuscripts and folios?

Also, isn’t a Hindu then entitled to say that his religious feelings are offended by Hindutva? Huh?
Update: Chandramohan has got bail, but I am informed that things are still tense in Baroda. The protest there has been called off, but is very much on in Mumbai at least.

Here is the problem...

Article 295a on the Indian Constitution.....

Contrast it with this.....

What a shame!! I did'nt know we were so immature that we have to sacrifice liberty to please some special interests.

Artist should not play with the feelings of the people. They are showing themselves as socilaite and high class people but they do very cheap work sometimes.we have example of M.F.Hussain.You just cant do anything in the name of art...
People dont like others play with their belief.Definately there is RIGHT of expression in the democracy but we should do anything for the sake of cheap publicity which angers people's sentiments.

I did not know that he had an elite social circle, thanks for that information - did you just pull that out of thin air.
Apparently you can do anything in the name of art, but not in India because there are some Talibanistic tendencies and people are so insecure that they get hurt by words and pictures, but they donot think twice before slitting someones throat in the name of religion and some related bulls*hit.
I think that BJP guy who came and slapped this student was more intereted in the publicity.

too liberal

are we getting too hypersensitive on this issue, i remember not too long back, that a cartoon of prophet mohemmed was published in a newspaper in a european country,,and what happened after that the whole world was burning with agitations and protests,,here a person paints naked pictures of our gods and goddesses ,,so i don"t think that religion should be a thing that anyone can do anything with it,,certainly the way of protest by that mr. jain was not right,,but in our society type can u expect something peaceful,,it is not the single issue,,i don't know why this issue is given so much hype,,just two days before three persons were burnt alive in cheennai,,when a unruly mob attacked the office of a newspaper,,,there are so many cases like this,,
i totally agree with yatinder....

You are right Sid
There are fundamentalist in our country. But Modernisation/liberalisation dont mean play with the belief of the people.I have so many friends about whom I can crack any type of bad joke, they will not say single thing. But when its question of belief they follow, they will not tolerate. This is very sensitive issue.
I dont understand why artist need to make this type of pictures(God/Godess in a bad way),There are so many subjects, they can portray in their pictures, but they do these things. Then they have support of so called socialite...
This is very silly...

" Jisski Lathi usski Bhains"

Sab Jat bhaiyon ko meri Ram Ram,
I read the thread n first thing that came to my mind is
" Jisski Lathi usski Bhains".
No one can touch MF Hussain neither BJP nor police and no one can book him under Indian Penal Code. We all know why and if some one tries to do so then also he cant succeed may be coz he is from minority community or powerful n thus allowed to paint whatever he wants. But anyone can beat Chandramohan it is not such a big deal. However if chandramohan's painting hurts people then is BJP representing the hindu masses.
I wonder How many hindus take care of twelve paintings of hindu gods/godesses on a single calender. I m sure most of them end up in dustbins every year to be replaced by new caboodle. I m sure majority of hidus do not care including BJP who is represnting hindu masses atleast in Baroda coz majority of hindus do it or may be they cant beat corers of hindus or may be coz no publicity is involved or they may lose votes.

Bro might is always right. Dont worry bout chandramohan coz there r so many chandramohan's in india n it can be anyone. So it may sound negative but its truth n happening from past 1000yrs in the world n will happen.

...Yo bechaara Chandramohan Baroda kaane galat hi fanss raha tha!

Mere khyaal tae yahee Andrah Pradesi (I think that's where he is supposed to be from) agar apnae State mein honta to ude zaroor yo bhi apne 'group' saathe kisi ki pitaayee kar rhya hota (kisis aur baat pae)...

Ya bus her State ki local gunda-gardee hai which is the straight and simple fact, apnae ghar mein saale saare sher bane firte hain.................... inhee Bjarangdal etc. chuhon ko agar kahein kae aandhra ya kisi aur South kae state mein jaake (where BJP is not in power) kisi artist ko haat laga kae aaiyen!?!...

Going into a college campus and thrashing/man-handling not only students (men and women both) but even the professors speaks of bloody *#@&* weaklings of the worst kind in a human form!

MSU election !!

This is purely a political stunt by ABVP leaders. Faculty of Fine Arts is not the first time targeted by local ABVP or NSUI leaders. Many times these student leaders target such Faculties in university as local election is upcoming due in June-July session. This will bring them in limelight thanks to our so called biased Media !!

I'm a ex student of MSU Baroda from 1999-2003. Did my graduation was staying in MV Hall and there was a local ABVP leader named Dangar who did the same stunt in 2001 before election.

I just read others views.Watever ABVP/Bajrang Dal/BJP has done, everyone is criticising that.Yes I am agree with u all.But no one is saying a single thing about the painting/artist.What he was portraying through obscene pictures of deities...
If the same thing he would have done with the Muslim deities, you would have criticised the artist,n would have said he is spreading violence...
WHY this PSEUDO-SECULARISM...I hate pseudo people...

You sure assume a lot my friend!! pseudo-secularism... where did you pick up that nugget? I personally would not have critisized him for drawing anything because I believe in freedom of speech and expression... you prefer to put conditions on it like this.....
I think you are in full agreement to this piece of crap in the Constitution
Section 295A. Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs
1[295A. Deliberate and malicious acts, intended to outrage religious feelings or any class by insulting its religion or religious beliefs.

Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of 2[citizens of India], 3[by words, either spoken or written, or by signs or by visible representations or otherwise], insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to 4[three years], or with fine, or with both.]
I wonder what Ambedkar was thinking!!

Anyway, if he had drawn those paintings related to Islam... he would have been dead!!

This is not a peice of crap bro...Wat makes u feel like that...This is as correct as anything. If u want to see ur country secular than this is best thing of constitution. We have maximum no of Muslims /Hindu /Sikhs in the world...What u expect in freedom of expression...It should not mean abuse to others...
Thats what I want to say...
Tomm... some art freak will paint our president in Nude,n next day something else...This is crap 4 getting publicity...

...Bhai logon, thamnae kisi nae wa paintings personally dekhi bhi hein, mka yun hee apnae sar takraan laag re so!?!

My personal views are that till it was not being displayed and exhibited at some public venue ...(and even then would totally depend on how much in 'bad taste' they were) it should not be a case of manhandling!
[this was an internal campus review of his work]...
The whole problem with the desh nowadays is that it does not take two minutes for self styled 'police' janta to take the law in their own hands!!!...

Of course (as is obvious even here) some people are ok with that concept of self styled ass*#*@ taking it out on defenseless individuals; as long as the action is 'licensed' thru some supposed 'misdemeanor' by the poor individual...

Bad choice gentlemen!

President in nude!!! - I don't think he is very inspiring.
Well, as far as freedom of speech is concerned we could go on and on. But in a nutshell - freedom of speech entails giving abuse - it means you can give abuse and will be protected under the Constitution. The executive and its instruments will protect you. Like I said earlier - words donot kill !!
We have all these politicians who take up these issues and start the drama and the people are foolish enough to follow the politicians. People donot realize that the words spoken by somebody are not that perverse and shamaful compared to poverty, illiteracy etc etc, but who cares.... they prefer to go to sleep hungry and die on the streets but their hearts fill up with sentimental drama when some Fu**ing politician gives a speech inciting violence. Then they take to the streets and start destroying property and slitting people's throats - I am sure thats not offensive!!
India is not grown up yet for that kind of freedom.

Its oversimplification

Well Mr Sidharth I think you are oversimplifying things. As per your judgement spoken words do not matter. look around you and see in your personal life faithfully and you will see how much they matter. You pointed few things which should be first priority rather than the present matter. I agree with you on that view that there are many significant things which needs to be taken care of,but I don't think this issue is insignificant. As long as beliefs are harmless we expect others to respect them. If some genius, inspired artist paint something nude from one of our family members what will be our reaction. Will we say that words doesn't kill and pictures doesn't harm.(For lot of people thier personal diety are much more important and they cannot be insulted, Not in the name of art and freedom of expression). Freedom of expression doesn't mean that we can say whatever we want to say.

And one more thing, there is much more we need to rather than just cursing politicians and sitting on our asses. Its not wrong to curse those sukers but cursing along will bring nothing. We need to do something on our own. We need to take some initiatives.

What the...

Well; the issue is also not as confusing as you are making it...dunno why people are mystifying the issue by giving examples of ' ourPresident' or 'a Family member' being depicted in a certain way and how it logically attracts 'manhandling'- No! The logic does not justify the means to that end!
In fact the 'lost cause' issue behind the discussion here really is (or should be) about those self styled moderators of the Society!

Since everyone here seems to like 'examples' so much...how's this one-
One day you get stopped on the road by two-three goons; slapped hard and then unceremoniously thrashed because the T-shirt you are wearing had some vague graphic on it that somehow 'insulted' those guys sensibilities! Kazaam! Just like that...;)
Of course based on what I read earlier am guessing that you would say wearing that particular t-shirt was a bad idea because those guys must have been evidently quite 'hurt' by it, right!?!...

Also, in the end since the word 'nude' has popped up around so magically like a theme button here; does anyone even know what the poor guy had actually painted??? (don't quote the punjab kesri styled Zee news or any other some sensationalizing news, please...)
If you don't know, stop using the word like some mantra that automatically washes away all evils!

That is exactly what it means..PERIOD - please read my earlier post

What do you plan to do?? Please be careful what you say or do against the government - because your ass might land up in Jail. THe reason is as follows...... see highlighted portion.
Freedom of speech and expression, which enable an individual to participate in public activities. The phrase, "freedom of press" has not been used in Article 19, but freedom of expression includes freedom of press. Reasonable restrictions can be imposed in the interest of public order, security of State, decency or morality.

You may not pay too much attention to the Indian Penal Code - but the government bureaucrats have it on the back of the hand.... when they send that police ka Jawan over to pick up your ass and he insults you in front of your family you will change your views on freedom of speech in a heartbeat.
P.S. I forgot to mention that you might also get slapped around by pahalwan that the local politician sent over to give you a maalish.

Shailendra bhai, Thanks for keeping it on the issue - gundagardi - In this case it happened because the BJP gunda (he is an advocate by profession) had it in the back of his mind free speech and expression is not highly protected in the country by the government and is left to interpretation.... so he could go ahead and slap somebody around and it would all be ok.
There are other incidents of gundagardi --- where the gundas are illiterate and obviously donot understand free speech.... but if you put their ass in jail for a few times they might begin to recognize it like they recognize dafa 420.

Hi Sid
You are going out of track from the title. We have concern over artist painting deities in obscene manner.I just want to say this is not correct and its not at all freedom of expression. This is INDIA.If you are staying out dont compare rules of those countries with India. They are very developed and they have open culture to accept things. But we are reserve in nature.
I havent understand Why you are talking like this on the name of Freedom of Expression.I am quite agree with Dharmvir Singh "If some genius, inspired artist paint something nude from one of our family members what will be our reaction. Will we say that words doesn't kill and pictures doesn't harm.(For lot of people thier personal diety are much more important and they cannot be insulted, Not in the name of art and freedom of expression). You havent given answer of this question.
Dear bro...Dont talk like Arundhati Rai...They are socialite..They want to be in news

Here are the right answers guys :

1) If that innocent artist really painted the gods/goddesses in nude, he should be punished. By whom and how - thats the question. In my view, his own nude pic should have been painted (and may be with his family) and displayed in the same Art seminar in the name of Freedom of Expression.

2) The so-called slapping by BJP Moral police was also wrong. These so-called cultural-keepers just try to be in news and show that they have power to do anything. They should have been punished too by reverse slapping.

Both the artist and BJP 'goonda' exerted their freedom of expression but way of expression was wrong in each case. So,they should have been given the same expression so that they understand the impact of it.

Oh perfect! Listen, I think the best thing would have been if this socialite art student (and silly me thought the key word is 'student' here...) had a big following of his own like that 'Dera' issue [going on in Punjab right now] and then both the warring parties here could have had a wonderful stand off (complete with bands, riots and 'aag-jani') Phaer koi galat nahee hota! Heh! Heh! Aisi cheezo mein jiski laathi uski bhains he hota hai!... ;):D

...and on a serious note: who knows maybe the student's high-profile socialite friends would still somehow form a suicide guerrilla unit and take the ABVP leaders head on!?!
