"Should the Govt amend HMA to ban 'same-gotra' marriage"?

Do you support same Gotra marriage?

  • Total voters
    166
No govt can avoid an amendment the day when 87% people would come on one side. How a govt can tide against such popular will? If you ask me, even I am against same gotra marriage but would I decide my vote to a political party based on that? Answer is NO. People prioritize things according to their need and I dont think that majority of the people fear same gotra marriage. More people dies on Delhi roads in a day than the number of intra gotra marriages in a year. For someone driving in Delhi, I am sure road safety would be a priority when electing a govt rather than same gotra marriage. For a housewife, rising commodity prices would be a higher priority. For an unemployed person, employment would be priority.

Some blind people think its only khaps who is pressurising for this gotra ban. Wake up !! No Khaps is doing what more than 87% Indian want. Even other communities are behind them. P.S. My English is not that good. Please dont point out spelling mistakes.

http://www.indianexpress.com/news/Mind-your-own-business--HC-tells-khaps/620105

The Punjab and Haryana High Court on Monday sent a strong signal to khap panchayats or caste councils, asking them not to behave like “paternal figures” and termed those indulging in unlawful activities as “lawless goons”.
Coming down heavily on a petition demanding prohibition of intra gotra (clan) marriages and amendment in Hindu Marriage Act, the division bench of Chief Justice Mukul Mudgal and Justice Jasbir Singh told the self-styled khaps to “mind their own business”.
Observing that India is a “free country” and there was nothing wrong in “people getting married as far as the marriages are according to law”, Chief Justice Mudgal remarked, “Peace can be assured only by arresting handful of lawbreakers who are roaming freely.”
Questioning the motive behind filing such a petition, an angry Chief Justice said: “How are you bothered if they (couples) don’t want to follow the customs but follow the law. Let society look after itself. This is none of your business in interfering in somebody’s marriage. You people stick to your customs and ensure that your children are married according to gotras but do not enforce these customs on society.”

Raising a strong objection to the demand of amendment of Hindu Marriage Act and issuing a legislation for prohibition of intra gotra marriages, Justice Mudgal observed, “How can the court give such a direction? Show us one Supreme Court judgment which enables the court to pass such directions to the legislature to issue a legislation.”

Chandigarh: Demanding a ban on same gotra marriage, the Akhil Bhartiya Jat Swabhiman Sangathan on Monday gave an ultimatum to the Haryana government and the Centre till May 22 to change the Hindu Marriage Act in this regard or face an agitation. The Sangathan has organised a Sarvjatiya Mahasammelan at Jind on May 23 to chalk out its future strategy. The organisers said the rally will be attended by people from Haryana, Punjab, Uttar Pradesh and Rajasthan. It has sent letters in this regard to the President, the Prime Minister and the chief ministers of all states. It has also demanded a review of the punishment meted out to the guilty in the Manoj-Babli murder case.

What is wrong if people ask for amendment is a law, Law are written by people and for people, which can be changed and has been done in past.
Khaps are social organizations, so it is their business. Chief justice take care of his business and work on some backlog cases, for which he is getting paid, Not for getting angry.

Sources of Hindu Law, Shruti, smriti & customs. Custom as source of law, over rides the written law. Essentials of customs:-
a) Ancient
b) Certain
c) Reasonable
d) Being inderogation of general rule of law
e) It must be established to be so by clear & unambiguous evidence
f) Must not be oppose to morality & public decency
g) Must not be prohobited expressly by legislation
h) Must not be against fundamental rights
i) Must be continuing, no break
Customs - local, class & family customs
2 Same gotra marriages are not allowed not only in our community but in many communities of north, it has been a proper custom, The custom is being followed by north Indians , Some cases of voilations were there, are there & will be there weather you amend the act or not, these voilations are taking place in other communities also but dealing with such voilations differs, we shought & show more but do less, we are not handling the situation properly. I am sure even after amendment, if at all it takes place, the situation for jats will remain almost the same.
3 SUGGESTIONS-
a) we have to be bit flexible, practical, human &transparent,Educate children on our culture customs etc, no self interest/eggo/politics while dealing with such matters, keep media & politicians away, If some incidant take place, keep law of the land in view while giving decisions. My openion, decision has to be social like a perticular community can seperates itself from such persons who have voilated the social custom.

regards

Could you please advise how to handle the situation properly. We would be greatful for an honest advise from an elder, respected and experienced member of the society

Same gotra marriages are not allowed in many castes in north India, this problem has come up in Haryana, Haryana has jat CM, amendment can be done to this Act by the State also, I am 100% sure, if mr Hooda adventures to amend, He will be able to do & will be hero for not only jats but other communities of Haryana. Lateron it will be very easy for other effected states to do the needful. Dr R kumar, why donot you help in this matter, using your relation in the family, the community will be grateful to you also. Dr sahab atlist convey my this message to the CM. Col Fateh Singh

when the custom is prevalent in the community. It is much different from making a marriage illegal when it conflicts with a custom. That is the only way out, when you are making a generic law that does NOT HURT anyone.
Taken from kapil Dalal's post above.

Marrying in same gotra and same village hurts the custom of Jats and these kind of marriages can be legalized under HMA so HMA is hurting Jat customs and that is the exact reason why a demand for amendment is being raised.

Jakharji, this is the opposite of what I was trying to say. There is NO provision in HMA that hurts the custom of Jats. If the HMA had explicitly banned marriage within cousins, then the communities that practise it would have been hurt. So, an EXCEPTION clause was added that no cousins can marry unless and until that custom is already prevalent in that community. So HMA does NOT allow for marriages within cousins (as most Hindus follow), but for a small minority who have practised it for ages. If the clause was not there, then the law would have RESTRICTED and banned some communities' customs.

Now, tell me, what clause is there in HMA that restricts any of the customs practised by Jats? What stops us from having as exotic rules for gotras as we want to? It is NOT illegal to follow Jat customs. The demand is to make it illegal for anyone to break this custom. An analogy of that would be that if 2 cousins belonging to a community that has the custom of cousin marriage, refuse to follow that custom against their parents' wishes, then it'd be a crime under the law. As they have broken the custom. Law can provide for customs, but customs are not (and should not) be law.

If the law has to criminalize breaking of customs, then where do we stop? Most communities have the custom of marrying within their caste, so inter-caste marriages should be deemed illegal? One can give countless examples. And I hate to use the term, but how is it different from Talibanization, where the custom of wearing a burqa becomes a law, breaking which is punishable by lashes.

On one hand, we love to say that we are a great community with great customs. What great customs when we are scared that our own people would stop following them? So we are literally begging (or blackmailing?) the state to step in to enforce the customs. It is ironically shameful. Great ideas never need to be enforced, they gain mass acceptance purely on merit.

In an All India Poll 87% people want amendment. Mind you that include all communities North, West, East, South. Dhobi, Teli, Jat , Baniya. Amendment will apply on to the people as per where they are domiciled.(Recently HC said that HMA may not apply to people who are permanently settled overseas). I assume it wont apply to NRIs(where both are settled permantly) and south, south-east, North-east or other areas where it wont be passed. I assume out of those 13% who are against amendment at least 10% could be Muslims or refugees or south Indians who dont follow this. How could we be blind to such a clear verdict. Moreover those who say Govt cant put restrictions. I have said earlier somewhere all those things are restricted which are agaisnt social norms or against morality. (like theft, incest realtionship sex in public place, prostitution (why ??? It satisty basic human need and should be legal?,polygamy, smuggling etc etc). Even daru is banned in gujrat. Govt can put on restriction to anything which it think is ruining society.

A society needs to be restricted on certain things. I think the law should listen to 87% people and do something for them otherwise as I said earlier make a universal Marriage ACT.

Some blind people think its only khaps who is pressurising for this gotra ban. Wake up !! No Khaps is doing what more than 87% Indian want. Even other communities are behind them.

P.S. My English is not that good. Please dont point out spelling mistakes.

Much is being made about this 87% polling result. I would suggest you should read about principles of justice. And please don't say it is not needed. If you are advocating a case for a new law, then you ought to know what law is. Though democracy is based on rule by majority, it doesn't translate into "my way or highway" approach. Laws have to be morally sound and not violate basic fundamental rights, even if 99% majority is in their favor. Not for nothing, judges who interpret law are not elected but appointed. And though majority can make laws through their elected representatives, the courts are given power to strike them down if they violate the basic fundamental tenets of the constitution.

Majority is not always right. If you conducted such polls in Delhi after Indira Gandhi's massacre or in Gujarat after Godhra, then I suspect you could have got a majority baying for blood. So would their majority status give them a right to indulge in rioting and killing?

And since when have opinion polls in media become policy making tools? These guys get even their most scientifically conducted exit polls wrong. You are quoting some sms poll where I suspect not even a 1000 people participated. And you can expect the participants to be those who feel very strongly about the issue- but in a real poll, you have only 1 vote, howsoever strongly you feel. If 87% people had wanted this, then an elected government would not have been ignoring it the way it has been doing so far. Trust the politicians to do what is popular, even if it is blatantly wrong. The only gauge of true numbers would be a referendum. In the absence of that, the only proxy is that how many MPs are demanding it. There are 530+, let us know how many have come out in support of the amendment?

87% people want amendment but how many people voted for that polls and what is their percentage to the overall population ? negligible. It is interesting to note that you even know about the caste and communities of the people who voted in favor of amendment and also about the people who voted against the amendment.

Trends may matter when a huge number of people are involved in the voting. It doesn't make any sense that just two dozen people are voting and people are talking about huge support for the amendment. If it were any Jatland policy then it may have mattered to jatland admins. But for the State or Indian govt. its negligible.

Same with the NDTV or any other channel's polls where 1000 or so people voted and that's amazingly ridicules the stregnth of Khap panchayat gatherings in thousands ( as they say ). It clearly means that even the people who supposed to fight for the amendment ( Khap supporters ) didn't voted for the amendment.

>>>>>>One such poll by HT where they choose people statistically. There were only nearly 300 or so. This was a sample and samples are used to predict a trend by some "not so intelligent people". Yes sample can go wrong sometimes but I have rarely seen where so many samples go wrong. :P . Anyway u dont have to agree with this. But certainly as Jakhar Bhai has said ' u didnt vote as well' :D

Soon you will see them fighting " I supported this first. No I was first."

A part from the article in History about this ban and kutru court's hypocrisy :-

===

Opening the country to FDI and collaboration regime in the economic field from the West, corporate world needs congenial atmosphere for entertainment of western investors who revel in sexual forays as entertainment. Smooth ground is being prepared by free India with feverish speed and removing all hurdles like family norms, which British rulers had feared to tread in their times. The country is being prepared for these ‘valuable guests’ with such infrastructure in place. Is it a mere sublime coincidence that, on one hand unnatural sex and live-in relations are made acceptable to Indian mind just on the eve of Commonwealth Games and, on the other a high pitch campaign is released for banning the custodians of family ethos like Gotra Khaps in tow? You are in a hurry to ban beggars in the Capital, de-criminalising gay sex, legitimising live-in relationship and clamping ban on Khaps in the interest of corporate capital to gain fabulous profits simply because these institutions do not approve of an alien agenda!! Is it not a part of the same game plan? Pl. deny, if it is wrong.

The Supreme Court on lesbian relationship and the central Home minister on Khap question recently pose the problem in sharp contrast as to the objective. Nearly sixty years after the country is free from British slavery, when Supreme Court of India found it necessary to interpret law on homosexuality and live-in relationship afresh as a fundamental right of an individual, while P. Chidambaram chooses to declare Khap system of social formation as obnoxious as terrorism today, the objective may not be as un-related and as innocent as these look to be at the first instance. Both hit at the very root institution of family on the strength of crash individualism of existential variety.

Majority is not always right. If you conducted such polls in Delhi after Indira Gandhi's massacre or in Gujarat after Godhra, then I suspect you could have got a majority baying for blood. So would their majority status give them a right to indulge in rioting and killing?

Polls of Godhra and Delhi .... does they make any comparison to Poll regarding a tradition that is being followed by crores of people and whether they want to carry this forward by bringing under law?

In response to a petition filed by Mr. Jakhar of Sonipat Haryana Hight Court asked evidence of whether this tradition is being followed.

Does a thorough survey of all castes, will not be able to help the APPOINTED ones to understand the social engineering on ground? What people are following and what they want to carry forward in future?

Modernity is also not good always .... Why we have some restrictions here and there ... isnt this impractical to not allow couples to enjoy their romance in public? Whats the harm?

One question -

Why spindas restriction is put in consitution?
Was there any medical research backing this at that time?
Or it was merely to obey the general traditions and social beliefs?
Isnt this a voilation for fundamental right of choosing his/her partner?

Why dont u teach us what are fundamental rights and what need to be included in law and what not and finish this debate for ever?

School main civics ki class mein nahin paddhe ke tanne fundamental right? Panchayati (khap) school mein paddha tha ke?
Ibbe late naa hoya sei .... google aala search engine bera hoga .... uspe toh lei ....

Haha aayiye manas ! Ek teri e kami rah ri thi is thread me. Baki jis school me bhi tha terle te badiya tha. Ode ve faltu bat bolni koni sikhayi jo kayi be tu bola kare he kayi threads me.

It is negligiable for people like you who visit this thread 100 times but do not vote either in favor or against it. make up your mind, tell us about your choice, now do not say that you want another option as then every one will ask for an option.
87% people want amendment but how many people voted for that polls and what is their percentage to the overall population ? negligible.

I have asked the same question in one of my previous post. If you put one community's customs in HMA and not others then it the violation of basic human right.
