It may happen that many of our customs and rituals are wrong interpretations of holy books ...

Taking on a potentially explosive issue, the Law Commission has said that bigamy conflicts with ``true Islamic law in letter and spirit'' and added that the popular perception that Muslim law in India allowed men to take four wives was faulty.

``We fully agree with the fact that traditional understanding of Muslim law on bigamy is gravely faulty and conflicts with true Islamic law in letter and spirit,'' the commission said in its 227th report to the government, reflecting the unanimous view of chairman Justice A R Lakshmanan and members Tahir Mahmood and B A Agrawal.

The panel, however, stopped short of recommending a change in the Muslim law as it feared this could stir an ``unhealthy controversy'' as religious leaders were not prepared for any legislative reform.

``It is generally believed that under Muslim law, a husband has an unfettered right to marry again even where his earlier marriage is continuing. On a closer examination of the relevant provisions of the Quran and other sources of Islamic law, this does not seem to be true,'' it said.

To buttress its argument, the commission said bigamy had been abolished or restricted by law in most Muslim countries. ``Turkey and Tunisia have completely outlawed it while in Egypt, Syria, Jordan, Iraq, Yemen, Morocco, Pakistan and Bangladesh, it has been subjected to administrative or judicial control,'' it said.

In the Indian context, the commission said, ``Bigamy is not very common among Muslims and cases of men having more than one wife at a time are few and far between. Muslim society of India in general looks at polygamy with great disfavour and a bigamist is looked down upon in and outside his family.''

Despite this, the commission said, change wasn't forthcoming. ``Unfortunately, religious leaders are not prepared for any legislative reform in this respect and religious sensitivities have never allowed the state to introduce any reform in this regard,'' it said.

The report was submitted to law minister Veerappa Moily on Wednesday by Justice Lakshmanan.
The commission said courts in India also looked down upon bigamy and provided all sorts of relief to first wives of bigamist husbands. ``Several high courts have held that bigamy amounts to cruelty which can be pleaded as an answer to the man's suit for restitution of conjugal rights against the first wife,'' it said.

``In one case, the Supreme Court had...observed that there was no difference between a second wife and a concubine,'' the commission added.

The major cause for population growth comes from these people. In the hindsight of their laws they marry more than one girl and keep on producing children.. They follow an "avalanche breakdown" path, 1 se 4, 4 se 16 and so on.. They truely deserve these -->:tamatar :thappad :boxing :boxing

Interesting Topic!

Dear Members,

It is interesting subject. I have couple of muslim friends, and once we were having discussion on the subject. A very educated person said that having more than one wife was the necessity or to help the newly formed community during the formative days of Islam. During prophet Muhammad's time, they were fighting a lot of war to establish their supremecy in the region. When a whole lot of women became widow, it was felt that they needed the protection of male family heads, and hence the idea of having more than one wife. Interestingly, as per religion a muslim having more than one wife needs to treat all his wives equaliy in every aspect e.g. his time, and money is to be equally divided among them.
They said that the idea has been grossly misused by the rich people specially, Kings and Princes. I believe in Saudi Arabia the Kings have had as many as 100 wives. Spending just one day with the lady and then giving her the nice house to live and a lot of money to spend.

The fact is no matter what is happening in other countries, we need to have a firm policy in our country. We need to tell people of all faiths in no uncertain terms that there is going to be only one constitution in this country. Take it or leave it? any one following any other constitution, should be punished severely. Do our political masters have the WILL to do it? That is the question. The law itself has lost its significance in the modern age. Ladies are as capable earning a livelyhood as the men are. So, they really don't need the protectioin of the man to survive. Every thing has a shelf life that is created temporary and so is this law. That is what needs to be taught to the society.
Not only that we need to oppose this law, we also need to close all the Madarsas in the country. We don't need them. Earlier we do it better we would be.

I agree with you Uncle ji... Instead of Hindu marriage law , there should be Indian marriage law. Our political leaders have no will and they can't do anything good for nation. No doubt, Muslims are highly responsible for population growth in India and say isme allah ka haath hai :D:D ... one nation, one law for every one, it should be followed in India....
