Worthy members,
This is one problem which has caused lots of bitterness in our villages. I am not taking any position here as to what is right out of the two options? If we go by law and equal right for women, then right is right and any crib about it will find no takers and hence when a daughter has a lawful right then whatever she does with that piece of land is not debatable. there is however a social side to it,which is of quite a significance because there lies a danger of bitterness in the hearts of pure relationships ie brother-sister, father-daughter and mother-daughter. Respectful and affactionate existance of any honourable society invariably depends on the later than the formar and truth lies there. When sweetness goes, nothing remains worth possessing. Here problem is not of those people who earn well and can take their right on property lightly but of those whose survival is dependent on a piece of land and hence bloody fights if any will be spoted there only. My all sisters have prefered it to be left with us [brothers] inspite of our insistance that they must own it[ and that option will remain open till we survive]. Here i would like to submit that even if they had taken their rightful land, our excellent relations since our childhood would not have affected a bit and have not changed a bit by their choice of living their part of land with us. It's thus a complex problem. I feel that when law of the land entitles them the equal share, why should a question be asked about it? but if a daughter/sister does not want to take it by way of a choice then why not respect that?
Warm regards
Dahiya Saahab,
I do agree with you. Sister's should have their rights in the property and it should be debated.
People here are discussing about what will happen when the sisters take their share and what they will do, when thrown out from their in-laws house? or how can a brother be sincere to his sister, when she take her share?
It should be strongly debated, only on one point: what happens when brothers take the whole share of the property and shows insincerity to their whole family (take it sisters or parents as well).
As, many of us must have seen this in our real life, when brothers say:
1. ..............main 'bhaat' ya 'seedha' nahin doonga.
2. ..............behan mere 'ghar' mein nahin aani chahiye (even when sister is concerned for her brothers and she is nowhere guilty).
3. ..............'maa' ya 'baap' ko 'chhota' ya 'bada' bhaai rakhega (when parents have given equal rights to their all sons, they should have the right to decide it on their own) (and here comes the 'sisters' to the rescue of their parents and that also without a 'hissa').
One more point to ponder........
What happens when a 'chacha' or 'tau' forcibly takes more share than other's? Is 'he' loyal? It is much better to give the share to our sister than to let our 'elders' enjoy it for free.
I have seen 'sisters' handling their parents, even when borther/s is/are alive and enjoying a good life.
If sisters don't have the right in ancestral property then 'those' brothers should also be forced to leave their rights on the share, who does not perform their 'duties' in the right ernst or are not good to their sisters, without any fault of the sisters.
Many parents are in the courts, against their sons. Why are they there? Is this their fault, that they have given equal rights to their 'sons' only and moreover, if the sisters could also have the right, then they must have given a much better life than many of us, to their parents (don't take it personally, as this is for those, not performing their duties or not loyal to their parents or sisters and I feel that, there are many of these).
Regarding the 'ijjat', one could give to his sister after giving share in the property, it solely depends on the individual and that giving our 'love' depends on 'land' sharing is totally baseless for me.
I am not against/with the sisters right to property but these points should be considered and let their be a LAW, governing the brothers/sons duty also.
I wanted to say much more regarding this, but better next time.......!!!
Thanks to all pondering here and the debate is going very well. I may be wrong on some fronts but lets take it forward.
Dear Jatlanders, this is just for a debate and my personal views (please don't take it seriously).
Thanks,
Shailendra Tokas
