How corrupt is Indian judiciary? What percentage of them could be corrupt? It must be rare that when a politically connected, rich Indian gets convicted? How long does it take for cases to get adjudicated? Months or years or decades? How big is the case backlog?

Highly corrupt.. I don't have facts and figurs but recently Karnatka High court judge was in the middle of some controversy.

I know that all session court judges lick around CM of the state..

Indeed...

Q 1: How corrupt is Indian judiciary?
A 1: Very corrupt.

Q 2: What percentage of them could be corrupt?
A 2: Some say at least 95%.

Q 3: It must be rare that when a politically connected, rich Indian gets convicted?
A 3: Very rare indeed. Unless the press gets after someone, chances are rather grim.

Q 4: How long does it take for cases to get adjudicated? Months or years or decades?
A 4: Average case of a common man may take anything from 10 years to a lifetime.

Q 5: How big is the case backlog?
A 5: If all judges and all others (advicates, jail staff, witnesses etc) cooperate and work 24/7, may be the backlog can be cleared in 15 years.

Best regards,

JS Malik

How corrupt can be gauged from two cases Jessica Lal case where DP Yadav's son got away with murder, he is real A$$hole, runs a factory where he doesn't pay his worker the promised labor pay and sometimes short change them.
Second Case the famous BMW Admiral Nanda's grandson case where prosecution and defense attorneys colluded to turn a witness hostile that is after the fact that 15 BSF Jawans were mauled by him while he was drunk. Admiral Nanda reportedly offered Rs 20 lakh per witness to keep his grandson out of life imprisonment and then parceled him out of India to USA. I have no sympathy for his, glad he died painful cancerous death. There are other cases also where one Dhabha owner killed his wife and burned her body parts in his dhaba's tandoor.
The same judges, law breaking public idiots convicted honest police officers for homicide who killed a fleeing suspect, This incidence happened after delhi bomb blast. I think it was SP Rathee and his men who all were Jats btw were given life imprisonment. India and her citizens deserve what they get, every terror strike, every criminal walking stalking them.

I have seen very closely the judicial system & enirnment there, as an advocate & got opportunity to handle few cases at the highest court & as a Registrar of the CAT of a state, And I agree that there is lot of corruption from bottum to top but dear brothers why only judiciary our legislative, executive & media all are equally corrupt. The reality is that few individuals may be exception otherwise we all are corrupt ofcourse degree may vary. if we all refuse to give bribe, judiciary or any other organisation, will remain clean. It is good to discuss such topics & more batter is to correct self, the whole nation/world will improve.

My question may divert the topic of discussions. I have almost 0 knowledge about administrative setup in our country. I am just wondering don't we have any safeguards against the fallouts. For Eg: Do we have some agency who keep on check of properties of judges and other administrative officers like IAS & IPS.
I know that in Spy agencies like RAW, CIA, MOSAD and MI5 etc, they have system in place which keep everybody under the circle of suspicion and there is always some kind of spying on all key elements.

If judiciary has this kinda of setup, then how come there is an corruption.
My another confusion is if there is a system failure, Then is it easy to replace the system or take some corrective action to improve it.

Dear Mor, good system always improve the functioning in any organisation also good suprvision, check, monitoring etc do have positive effect, but all these can have limited change. unless & untill thinking of complete society changes & self discipline improves we cannot clean the deep ruoted corruption. you will surprise to note that people deputed on so called spying jobs, get involed in bigger corrupt activities by making use of their positions. no self praise, in 1991 when I was jt Director Legal in Delhi, I wrote a long paper on Administrative reforms, initially many Babus praised the work & after some time most of them were hasitant to talk to me & my functioning became bit difficult with various ministries. Any way we have to improve the system as well as the thinking.

Not only the Judiciary

Not only the judiciary but also ligislature, executive and adminstration fom bottom to top level all are corropt.why people are blaming only judiciary for the pendency of cases the same is not only because of corruption, but there are other reasons like indifferent behaviors of advocates, litigant and witness, and due to our legal procedure.
At least the judiciary should not be corrupt, people have faith in the judiciary if it will not function properly which is supposed to be the safegaurd of people's rights, then where people will they go.
Nothing can be done, untill n unless every person will not aware about this, and will take intiative.

Dear Mor,
there is vigilance committe and vigilance officer who keep watch on each and every thing at each level like district Courts, High Courts, but do you think they are working proplerly ? No absolutly no? becasue they are also the same persons. As per my knowledge even in Tis Hazari District Court Delhi you will found many vigilance officer deployed but i have not heard a single case has been found by them, even illegally people take judicial file out side the court get photo copied which ever is required.
Even in case of Judges if found corrupt who will take action and make inquiry ,will also be Sr judge and they are always biased.Even in no of cases against Judges, High Court itself advised them take voluntary retirement, will not take action, recently one ADJ from tis hazari i do not remember the name took voluntary retirement after found in possession and owner of unproportionate assets. and inquiry against many more near 13/14 was pending but no outcome.

Although now the Judges of Supreme Court of India and High Court of respective states have given details of their assets on Supreme Court of India's site.

Mr Joginder Singh (ex-chief CBI) once claimed on a news channel that he was pressurized by Congress(during its rule) when he was investigating Bofors case. Jab itne bade aadmi ne kaam nahi karen dete dhung te to baki to bahot choti cheej hai. Upar se niche tak sab mile hue hai.

I wuld like to share a true example here about corruption. Gurgaon me ESIC(Don't remem exact name:rolleyes:) ke dpartment me chaprasi hai ek (may be ab retire ho gya ho,may be!).Mera room-mate ude linux administrator laag rhya tha 2 saal pahla wo btaya karta. ESIC me factory walo ko apne employees ka medical beema karwana padta hai. Wha se medical claims bhi pass hote hai govt employees ke bhi. Par factory wale karwate nahi time se paise bachane ke mare. Jab chappa padne ka darr hota hai tabhi karwate hai. Or wo chaprasi isi baat ka fayda uthata hai. Wha par har roj takreeban 100 ke aspas log aate hai form jma karwane. Wo chaprasi har form ke 10 Rs leta hai. Je koe jave 5 form le ke to usne 50 dene padenge us te kaam karwaan tai. Eeb aadmi kaam karwaan khatir 50 de de se. uske ghna sa farak bhi nahi padta. par hisab lagawe to to wo chaprasi roj ke 1000 mar jya se(minimum considering one person comes with one form).
Us chaprasi dhore gurgame me 2 plot se 500-500 gaj ke sector me. Donu plot usne ise kaamayi te kahreede se.. :D Lya lyo bhai hisab ib corruption ke meter te ak kitna fael rhya se:rock

Hi Sir,

Are you taking about district courts or High courts and supreme courts also? If you include High and Supreme Court then the % will come down drastically.

My father is working in Pb and Haryana High court for the past 20 years (Special Secy. to different judges, including Chief Justice). He has close contacts with over 70% Judges in different High courts and Supreme Court.

By his experince I can tell you that you are getting it wrong. Of all the judges he knows over 90% are clean in every manner. The backlogs, time taken for justice and special treatment to VIPs are not due Judiciary, its because of Police and Lawyers.

The backlog is due to very less number of judges in High courts. (You can verify on Google).

The special treatment to VIPs is due to Lawyers and Police. You must know that if on 1 hearing if Lawyer says he is not well and cant come for hearing, the next hearing is postponed to 6-8 months (again due to backlog).

Secondly Police doesnt submit enough evidences at one go and the lawyers always play with their evidences (it agains take much time).

About Manu Sharma and others its Police/State Govt. who provides evidences that whether they shoud get parol or not.

Judiciary works just on the evidences and people. So it would be not good to blame them for slow work.

I can say all of these because I am part of it.

Hope this will clarify many misunderstandings to all people.

PS: Malik sir is right about Lower Courts but still only 50% of them are corrupt. (We cant say very corrupt here because 50% is way less than % compared to politicians, police etc.)):)

Dear Rohit it might be possible that to whom your father's have contact out of them 90% are fare, but in Supreme Court of India or High Court's for releif from a particular bench you need to be appeared through a particular Advocate what matter is the face value. n you know why this face value, i think u are enough able to understand. i am also not with the view that everyone is corrupt but majority of them.

But exception are everywhere.

In addition to above post, judiciary includes many other people other than judges, they are 1000 km away from honesty.
