Dear Members,
Quite often we hear and now see what our representatives do in State Assemblies and Parliament. The problem is that in spite of their un-parliamentary behavior and sometimes even language, we still re-elect them.
More often than not, when a person does not have a valid argument to prove his/her point, usually starts indulging in such activities. Even on this forum, we do see personal attacks on other members when some of us run out of a convincing argument.
I was wondering, what should be the ideal behavior for a parliamentarian? Some times the speaker of the house is responsible for such incidents because of the partisan attitude. Could it be possible to make a provision in the law where the speaker is selected/elected outside the political parties? Or a parliamentarian is debarred from participation due to unruly behavior not only from participating in the discussions but also contesting the next election. Also these people should be asked to pay for the damage to the public property.
Let us discuss, following:
1. Should we do it? If we do, would it be limiting the freedom of speech?
2. If we decide to do it, how can it be implemented? I feel there are enough laws to make people behave, but the implementation is the problem.

Sir,

Nice topic. I think debarring is such an extreme step, that even if it is right, it won't fly with the parties. Plus it would be open to abuse. Simpler solutions are better, which can be quietly implemented. For example, there should be objective rules about speaking turn by turn, not rushing to the well of the house and not shouting slogans in the parliment. Anyone who breaks this rule should be fined with the fine amount increasing everytime the offense is repeated. The amount should come from the party which should be legally bound to pay it (Or it can be deducted from the funds available to MP for his constituency so that his constituency can punish him in next elections). The concerned member should be suspended till the fined amount is paid. The amount as well as the associated -ve publicity should be sizable to act as a deterrent. And the Election Commission should release the entire list for public so that they take this into account while making their decision.

Whole heartedly agree that there are argumenst for the sake of it and it is really disappointing to see that. There is no quality in the debates , more often than not the idea is to project the other party in a bad sense and nothing else. There is no constructive appreciatioon/criticism!

Yes , the parliamentarians are also citizens and they should be made to subject to the same laws. They cannot do what they like ! There should be strict restrictions on the kind of language they speak. Some of the sugegstions of Kapil can be directly put to work!

Regarding whether it's limiting the freedom of speech , i guess not because every person's right to freedom of speech and expression is limited by other's and its disgusting to see that crappy discussion and shouting etc going on in the parliament! !

Dikkat to yahi hai ki 10 neta chunao main khadey hotey hai and 10 ke 10 aise hi hotey hai.

Agar kisi achhey se bandey ko neta bana dogey to usey bhi survival ke liye bakio jaisa ban na padega...
Merey hisaab se kami netao ki nahi, elect karney walon ki hai..
Unke liye voting karna koi serious kaam nahi hota..
wahan sirf ye dekhtey hai ki ye neta merey liye kya kar sakta hai...not ki desh aur samaaj ke liye kya kar sakta hai...

Aur rahi baat kuchh implement karne ya karwaney ki to wo to (NETWORK COVERAGE SE BAHAR KI CHEESE HAI) practical saa nahi lagta.

Change ki jarurat hum logon ko hai , na ki system ko....

Hum jaise log hi election and ralliyo main unkey support main (beshak kisi bhi swarth ke liye) khadey dikhtey hai unki hausla afjaayi ke liye aur unki durbhavnao ko sashakt karney ke liye.

Apney aaap ko sudharo, desh aapney aap sudhar jayega;)...(Maine aapni soch vayakt ki hai, kripya personally na lekar jaye)

I strongly feel that it’s high time that we bring some strict law and drastic change in our constitution for the betterment of our country and coming generation.

Any kind of freedom if being misused it must be controlled by some sort of strict action no matter if it sounds harsh or undemocratic. There are only two ways that either people themselves understand the responsibility or make them understand the responsibility by any means.

I humbly disagree with you Mukesh Bhai. There is no dearth of Laws in our constitution the important thing is the implementation.

We have adequate laws, tell me how many people know about RTI(Right To Information Act) and how many people are using it. RTI is an excellent tool if responsible citizens start using it, otherwise after some time it will also loose its shine.

I strongly feel that it’s high time that we bring some strict law and drastic change in our constitution for the betterment of our country and coming generation.

We should BRING SOME STRICT LAWS.
WE SHOULD CHANGE THE CONSTITUTION......

Solution is very good.
But who is going to do this?????????

Kisis kew pass hai itna time jo post karney ke alawa practically kuchh karney ki himmat rakhta ho???

Apney kaam se fursat miley tabhio kuchh ho sakta hai..
Wo kisi ko milti nahi..

Anyways goos thinking...

Some of my fellow friends think that there is a problem with Law or rules no the problem is with the implementation of those laws u know there r special force available in the Parliament at the time of the session but they act when they asked to act by the speaker only.
So the problem is not with the Laws its purely with the way these rules has been implemented.

Chhottey bhai... issue yeh hai ki.... the power to change the law or to bring a new law is also in the hands of these politicians :(

Kitt kitt rowein inn ne? :(

Indian Vs US democracies

.
If we look at perks and facilities being enjoyed by MPs of poor India, it is amazing (though their cash allowances do not seem to be that much attractive). A posh accommodation in Lutyens Delhi (which even Ratan Tata would envy), lot of travel facilities, free electricity and phone ... the list is endless. And he/she has to attend the parliament only for a couple of weeks in a full year !

On the other hand, see US democracy - Barrak Obama was to take over on 20 January 2009 and his children's schools were due to start on 5 January. He requested for some alternate accommodation in Washington DC. His request was rejected and he had to stay in a hotel till 20th January, paying a daily rental of US $ 1600. Earlier, when Bill Clinton left White House, the packers packed a sofa by mistake, in his personal belongings. Later, Bill Clinton had to pay back 3000 dollars for that lapse. Is it possible in India where MPs and Ministers sometimes take away even the furniture when they leave govt. bungalows ?

When US President makes high-level appointments, the concerned candidate has to undergo a lengthy process and has to face the Senate which grills him over embarassing interviews. If Senate rejects the candidate, he does not get the high office. But in India, it is so easy ! That is why semi-literates happen to be occupying high posts of ministers, governors etc.

India's Constitution is pretty lenghthy but where is the dedication to implement rules? It is well said that a nation gets the leaders it deserves of.

No solution in sight...

I can only think about one solution for the present set of legislators. And I am serious when I say this. I saw a movie sometime back in which prisoner wear such a device.

Implant one device inside each of the legislators as soon as they have taken the oath for that particular session. The implanted device should be so designed that it should be able give a 'Mild Electric Shock' to a member as soon as they speak out of turn, raise their voices above a certain decible level and use foul language. Each device implanted can be so programmed that a member can only go to his seat by taking a particular route and go out. Should a member rush to the well of the house, a 'Medium Electric Shock' be suffered.

The device could be implanted in any part of the body. Personally I feel it should be in their butts.

Excellent idea Sir ji I humbly agree with you:rock, selection of strategic location for implanting the device is highly appreciated

Idea to bilkul perfect hai. lekin us device ko age aur body basics ko dhyaan me rakhkar banana padega, lagbhag above 50 % neta are old age. kahein aisa na ho 2-3 mild er medium electric shock lagte hi ram naam satya ho ja unki.

As per my view Jo neta election me khada hota hai uski education minimum graduation honi chahiye aur wo kisi aapradhik gatividhiyon me lipt na ho ya uske khilaf koi court case na chal raha ho. Tab to sudhaar ho sakta hai. Otherwise SUPREME COURT also said once that GOD ALSO CAN NOT CHANGE THIS COUNTRY. :)
