Dear Vipin ,

In Manoj Babli case - the mother and sister of Manoj were harassed and they have approved the marraige ,ther other cases also like : "Khedi Meham case -Dec'09", anyways pl refer to the article "Khap Panchayat Signs of desperation" published in Hindu-in May-7 2010 or
the article in outlook:
society: khap panchayats:Hardcore Courts:It’s selective barbarity. The rich are spared; local politics, land influence most cases.

I am sure, a newspaper like Hindu and a magazine like outlook will not publish article like this without proper research

P.S: Couldn't paste the link : not allowed:(
Regards,
Satyendra

Bhai Shaheb,

Manoj's mother that time was not scared or anything in fact they were speaking totally against villagers. She didnt approve the marriage. She was just against the killing. She said " aise shadi karna to galat h hi. Par ab jab kar hi li to hum chahte the vo bag jaye aur gaam me khabi naaaye" The link of this was pasted on the site as well. But as soon as she said that the reporter zoomed the camera on some other lady and changed the topic. This thing was not highlighted.

But still i would like to read your news. you can , may be go in my profile and paste the link there a a visitor message.

I cant comment on the hindu and outlook news unless i read it

P.s. the manoj's mother's word are out of memory. Words dusare ho sakte he par matlab yahi tha. For exact worlds please watch that video which was pasted on this site.

Were you refering to this article by Jagmati Sangwan
http://beta.thehindu.com/opinion/lead/article424506.ece?homepage=true

This article also doesnt say anything about your claim that "(in fact in most of the intra gotra marriages happened with family's consent):

On contrary it says : Among the several instances of khaps issuing fatwas in Jaundhi, Asanda, Dharana, Singhwal, Hadaudi, Maham-kheri, Ludana and other villages, not a single one was an intra-gotra marriage

May be you are confused with this "same gotra" thing.

Also this article is already discussed lot of times on this site. We all know the agenda of Jagmati sangwan.

This are her personal views and nothing to do with the authenticity of the Hindu.

The Law Ministry swung into action after Union Home Minister P Chidambaram wrote to Union Law Minister M Veerappa Moily expressing a sense of urgency for a new law to make the punishment for honour killing extremely stringent.

Under the new law, the accused will have to prove their innocence as against ordinary criminal cases where the state has to prove the guilt of the accused.

According to Mr Moily, under the new law, members of Khap panchayat, who order the killing of the couples, who dare to go against the dictates of these panchayats, will be treated as accomplices in the crime.

This is the wrong approach of the GOVT. If this law is implemented than these communities like jats ,gujjars and rajputs would feel more alienated and more chances are this law would be misused.

The killing is mostly done by family. This issue isnt limited to Khap. It happens in non-khap area as well. Even MR Hooda, the CM has said this.

Everyone, including khaps, who are not involved in the crime need not fear from any such law. It is the same way that we have other laws to deal with criminals and respective punishments. Innocent and law abiding people don't need to fear anything.

You need to stop believing that whatever the media writes , is the Gospel truth.

The Hindu and the Outlook are no exceptions.

Please take a crtical look at what is in the artciles and question them.

Try not to be so hasty to accept whatever is put forward by them.

Exactly. Law abiding citizens need not be panicky of such laws. The proposed law will affect only the vigilantes and not the 'innocent' khaps.

This law says :the accused will have to prove their innocence as against ordinary criminal cases where the state has to prove the guilt of the accused

U are a very honest person for whom humanity is everything. Moreover u are human first than indian and than Jat. U probably dont know the structure of a jat village. This law could be misused and the approach is not right to put the onus on accused rather than state. If someone(brother e.g.) kills x than all x's near relative could become accused and they have to prove their innosense rather than otherwise in other criminal case.

Moreover khap dont order killing but they would definately say such marriage are wrong. How would they be treated? Accused or not accused? Fatwa is just an opinion. Khap's fatwa means khap's opinion.
khap's fatwa against a particular marriage means khap's opinion against that marriage.

They already have law for murder.

Dear Ravi,

I do agree that media senentionalise the issues and present it in spicy form but they dont report the things without facts at least Hindu and Outlook are v reponsible in that regards ( I have worked in association with both of them and can verify the same). Another thing they have no reason to be biased against one community.
Its high time we should stop blaming the media for tarnishing the image of jats or khaps and thus shielding our community traditions drawbacks/outdated customs.Rather we should work on the solution (Modifying HMA and honour killing is no solution)and if require modify the customs as per the demand of time. And if nothing is possible then we can at least be little tolerant

Satyendra

.
Please clarify in some detail, what is your relationship with Outlook and the Hindu, and why you are so confident about their adherence to veracity.

Please give examples.

Please be specific,( not argumentative).

Agreed that media is not 100% incorrect. At least Hindu and Outlook are respected in this area (and my views are not based only because of “Walking With the Comrades”). - In my opinion, the worst one is the beloved TOI.

However, I totally disagree with you on suggestion of modifying the customs and the HMA amendment. The reasons are:
1 - Honour killing is not a custom. It has more to do with the psychology then amending HMA. In fact, amending HMA would definitely reduce the incidents of honour killing. The reason is simple; it would then become a legal issue rather than an honour issue.

2 - Customs are never modified directly, they automatically change and get adjusted as per the passage of time. People automatically start accepting them when they find them irrelevant. You, I or the media does not have to tell to the people.

3 - While I personally haven't digested the need to amend HMA (reason being that, it would be difficult to legalise every custom), I find absolutely no (other) harm when I start reasoning. Self governance is a United Nations mandate and fundamentally stems out from democracy. So, if Jat community wants to bring a particular legislation for themselves, then what is the harm? Most of the voices which are against this move are not Jats themselves or do not believe in the Jat customs.

4 - I totally do not find any merit of this "love" story that people imagine and tell. People love their parents, their brothers, sisters, cousins, dogs, animals etc, but do not marry them. Love need not translate to a marriage. I believe that, the “love at first site” is actually a sexual infatuation first. I agree that love may also happen, however, logically that would be the next step. In other circumstances, the vice versa can also happen. The whole point is that when HMA gets amended, people would know that the relationship would not be legal from the very starting and hence the “love leading to marriage” relationship would not happen.

5 - If a Jat member does not want to come under this act, then he or she is free to move out of the community. Just like people convert from one religion to another. So people would still have the liberty to bypass the legislation.

6 - I do not know of any direct or indirect harm which this amendment could possibly bring. What are the cons, if any?

I second Satyender's opinion about outlook and The Hindu. In comparison to other newspapers and magazines these two publications are highly reliable. Mr. N. Ram, the Editor of The Hindu enjoys a very good reputation and has always maintained high standard of healthy journalism. We cannot ask people to produce supporting documents for each and every statement. Different people perceive things in different ways and look through different prisms.

It is pretty immature to say that "If a Jat member does not want to come under this act, then he or she is free to move out of the community". Do you think simply not falling in line with a majority opinion converts someone into another caste overnight. Caste is not a region which can be changed by completing some rituals. It is determined by someone's parentage which is not possible to change by the self-styled custodians of traditions. People may agree or not to some amendment in HMA, everyone will be constrained to follow it if they would like their marital status to be legalized. Hindu Society consists of so many ethnic groups and it may pose so many complexities in making separate laws for each and every caste. Those who have faith in customs will follow on their own, those who do not, will find their ways to bypass the HMA. It is difficult to thrust upon the people each and every custom with the force of legal machinery.

If there is no harm in the demand for amendment in HMA, I do not see any merit either. It is sheer wastage of time and resources which could have been utilized in some better development oriented programmes. Another biggest disadvantage of this whole exercise is a clear and deep divide among the community. The unending squabbles between the "Khapites" and "Non-Khapites" on this thread is an example. If the trend of demands/agitation by the different communities for encapsulating all the traditions continued at the present pace, no one can save the country from going to dogs. Therefore, we need to come out of this cocoon of casteism on such issues and think in broader national perspective.

99% of Jats know their customs and have been following without any advice from the clergy. Simply because of 1% exception no amendment is required. Therefore, the plea for amendment is wholly untenable and unwarranted. Usually those who pretend/proclaim to be staunch follower of customs turn out to be hollow when a litmus test is given.

continue..

Well, the only merit I see is that the cases of honour killing would come down.
Overall, there is little merit and little demerit. However, the issue in itself is quite significant and should be debated well for its future consequences.
